Wow! California Governor Gavin News is playing a role this week! He is signing left and right bills to make a significant impact on the Golden State. Today she signed Bill AB-453, which prohibits the removal of condoms without permission during intercourse, also known as “stealthing” according to the KTLA.
The bill amends the state’s current civil code, adding the law to the state’s civic definition of sex batteries. Under AB-453, victims can sue victims with punitive damages. Also, removing a condom without verbal consent makes theft illegal, although California law would not make stealthing a crime.
Many cannot believe that this is not already happening, including State Councilor Christina Garcia, who was a patron of the law. Christina spoke to NPR and said, “For most people, yes, it is understandable that it is immoral and it should be illegal. A lot of people told me, ‘I can’t believe it’s not already illegal.
Governor News has not yet signed the bill. The report further states that he has approved a second bill sponsored by Assembly member Garcia regarding rape. Bill AB-1171 will repeal the provisions relating to marital rape and make changes consistent with it, making sexual intercourse with husband and wife punishable as rape. However, if the law meets the definition of rape, except for sexual intercourse with a person unable to give legal consent due to mental disorder or development or physical disability, it will not be rape if the two are married.
